User: Any individual who visits, accesses, registers, or uses the Platform or services provided by AlmaBetter, irrespective of their registration status.

Student: A registered User who formally enrolls and participates in one or more courses offered by AlmaBetter.

Course Fees: The financial consideration payable by the Student to AlmaBetter to access, enroll, and participate in the educational services offered.

Section 3: Eligibility and User Registration

Age Restrictions To register for an account and utilize AlmaBetter’s services, users must be at least eighteen (18) years of age. By accessing or registering on the Platform, users explicitly affirm that they meet this minimum age requirement. AlmaBetter reserves the right to verify the age of users and to restrict access or terminate the accounts of users found to be below this specified age limit.

Account Creation Procedures To utilize specific features or services provided on our Platform, users must create a personal account. The account creation process requires users to provide complete, accurate, and current information, including but not limited to their name, valid email address, contact number, and relevant personal details as required. Upon successful registration, users will be granted a unique account identifier to access our services.

Accuracy and Confidentiality Obligations Users must ensure that all information provided during the registration and subsequent interactions with AlmaBetter is accurate, current, and complete. It is the sole responsibility of the user to promptly update their information if there are any changes. Users must maintain the confidentiality of their account login credentials and are solely responsible for all activities occurring under their account.

User Account Security and Reporting Obligations Each user is solely responsible for ensuring the security and confidentiality of their account credentials, including usernames and passwords. Users are required to immediately report any unauthorized access, suspicious activity, or security breach concerning their account to AlmaBetter. AlmaBetter disclaims all liability related to losses or damages resulting from users' failure to adhere to these security obligations.

AlmaBetter's Discretion in Accepting or Terminating Registrations AlmaBetter expressly reserves the right, at its sole and absolute discretion, to accept, refuse, or terminate any user's registration or access to the Platform and services without prior notice or explanation. AlmaBetter may restrict access or terminate accounts due to reasons including, but not limited to, violation of these Terms of Use, misuse of services, provision of inaccurate or fraudulent information, or for reasons related to security and operational integrity.

Live sessions are scheduled at regular intervals, clearly communicated to enrolled students via the Platform. The nature of these sessions encompasses theoretical instruction, practical demonstrations, real-world case studies, and interactive discussions. Session durations typically range from one to three hours, depending on the complexity of the topic and curriculum requirements.

Recorded Lectures All live sessions conducted by AlmaBetter are recorded and made available on the Platform. Students receive lifetime access to these recorded lectures, enabling flexible and self-paced learning. The scope of recorded lectures includes comprehensive coverage of course content, step-by-step explanations of critical concepts, practical demonstrations, and supplemental resources designed to reinforce learning outcomes.

Ebooks and Learning Resources Students enrolled in AlmaBetter courses receive access to a diverse collection of digital ebooks and supplementary learning materials. These resources are meticulously curated to enhance the learning experience and complement the primary instructional content. Access to ebooks is perpetual upon enrollment, subject to compliance with AlmaBetter’s terms of use.

Mentorship and Doubt Resolution AlmaBetter provides personalized mentorship services through experienced industry professionals. Mentors offer guidance, clarify doubts, provide insights, and help students effectively navigate course material and career development. Students can access mentorship and doubt-resolution services within the designated support period (12 or 24 months depending on the enrolled course). AlmaBetter maintains discretion regarding the extent, availability, and modality (such as one-on-one or group sessions) of mentorship provided.

Practice Materials and Assessments AlmaBetter equips students with targeted practice materials, quizzes, and assessments to evaluate learning progress and practical skill acquisition. These resources are designed to simulate real-world challenges, thereby effectively preparing students for professional environments. Continuous assessment and feedback mechanisms are integral parts of the learning process, providing critical insights for students and ensuring mastery of essential skills.

Placement and Career Services AlmaBetter offers structured career support and placement assistance services. These services include resume-building workshops, mock interviews, industry networking opportunities, personalized career guidance, and direct job referrals. The scope and extent of placement and career services are available for up to 12 months post the signing of the Income Share Agreement (ISA). AlmaBetter reserves the right to modify, extend, or limit these services based on operational considerations, industry changes, and student performance and compliance.

Section 5: Payments and Billing

Fee Structure Details Course fees applicable to each AlmaBetter program are clearly specified on the Platform. The fees may vary based on the nature of the course, duration, included resources, and support services. Fees are payable in full or according to structured installment plans as indicated by AlmaBetter.

GST Specifics AlmaBetter’s educational services attract GST at differentiated rates clearly delineated in the billing process: a 5% GST rate specifically applied to ebooks, and an 18% GST rate applicable to all other educational and placement-related services provided by AlmaBetter.

Invoice Issuance AlmaBetter issues detailed invoices upon payment confirmation, explicitly stating the breakdown of course fees, applicable GST rates, and total payable amounts. Students can access their invoices digitally through their registered accounts on the Platform.

Payment Methods Accepted AlmaBetter accepts various payment methods for convenience, including credit cards, debit cards, net banking, UPI transactions, and digital wallet payments. Users are required to adhere to the payment methods and procedures as detailed on the Platform.

Consequences of Non-payment AlmaBetter grants access to course services and resources only after the full payment of applicable fees is successfully completed. Non-payment or partial payment of course fees will result in non-activation of the student's account and withholding of access to all AlmaBetter services. AlmaBetter reserves the right to take appropriate actions, including legal action for recovery and reporting defaults to relevant credit bureaus in case of payment defaults. Students are encouraged to proactively communicate with AlmaBetter to address any financial concerns or discrepancies.

Section 6: Refund and Cancellation Policy

Clear Non-Refundability Clause All course fees paid to AlmaBetter are strictly non-refundable. Students must ensure they clearly understand and agree with the course content, structure, schedule, fees, and all related terms before enrolling and making payment. AlmaBetter does not entertain refund requests once the enrollment process is complete.

Conditions Regarding Cancellations Enrollment cancellations initiated by students post-payment will not qualify for refunds. Students opting to discontinue participation in the enrolled course do so with the explicit understanding that no financial compensation or refund will be provided by AlmaBetter.

AlmaBetter’s Discretion AlmaBetter reserves the absolute discretion to review cancellation requests under exceptional circumstances, such as severe medical emergencies, supported by sufficient documented evidence. Such cases are considered on a strictly case-by-case basis, and any decisions made by AlmaBetter regarding cancellations or potential refunds are final and binding.

Section 7: Course Pausing and Resumption

Terms for Requesting Pauses Students enrolled in AlmaBetter’s courses may formally request a temporary pause in their course participation. Pause requests must be submitted in writing through the Platform or official communication channels clearly stating the reason and intended duration.

Criteria for Approval/Rejection Approval for pause requests is at AlmaBetter's sole discretion and contingent upon factors such as the validity of the provided reason, the academic standing of the student, and resource availability. AlmaBetter retains the right to approve, reject, or modify the terms of the requested pause based on internal evaluation criteria.

AlmaBetter’s Discretionary Rights AlmaBetter holds exclusive discretion regarding the acceptance or rejection of pause requests, the duration approved for the pause, and conditions imposed during the paused period. AlmaBetter reserves the right to alter terms related to the pause duration, support services during the pause, and course resumption procedures.

Detailed Procedure and Requirements for Resumption Upon completion of the approved pause period, students must formally notify AlmaBetter of their intent to resume their studies. This notification should be submitted in writing at least 3 days prior to the intended resumption date. AlmaBetter will review and confirm resumption, detailing any additional requirements or conditions necessary for reintegration into the course. Failure to resume within the agreed timeline or without fulfilling required conditions may lead to permanent course termination without any financial refund.

Section 8: User Conduct and Prohibited Actions

Explicit List of Prohibited Activities AlmaBetter strictly prohibits the following activities on the Platform:

Unauthorized use or dissemination of AlmaBetter’s proprietary content
Sharing account login details or unauthorized access to other user accounts
Posting offensive, discriminatory, defamatory, fraudulent, or obscene content
Attempting to disrupt Platform operations through hacking, denial of service, or similar activities
Violating intellectual property rights belonging to AlmaBetter or third parties
Engaging in unlawful, harmful, threatening, abusive, or otherwise objectionable conduct

Consequences of Violations Violation of any provisions mentioned above or general misconduct may result in immediate suspension or termination of the user’s account and permanent loss of access to all AlmaBetter services. Serious breaches could also lead to further legal actions.

AlmaBetter’s Rights to Investigate and Prosecute Violations AlmaBetter reserves the right to thoroughly investigate any reports or suspicions of prohibited activities or misconduct. AlmaBetter may collaborate with law enforcement authorities and initiate legal proceedings against users found in violation of these terms. Users are obligated to fully cooperate with such investigations and provide necessary information or assistance as requested by AlmaBetter.

Section 9: Intellectual Property Rights

Ownership and Licensing All educational content, including but not limited to recorded sessions, live session materials, ebooks, practice resources, assessments, logos, trademarks, and any other materials accessible through AlmaBetter’s Platform, are exclusively owned by AlmaBetter or its authorized licensors. AlmaBetter grants students a limited, non-exclusive, non-transferable license to access and utilize these resources solely for their personal, educational, non-commercial use in alignment with these Terms of Use.

User Restrictions on Content Usage Students and users explicitly agree not to reproduce, distribute, modify, publicly display, or commercially exploit any content or resources provided by AlmaBetter without prior written authorization. Users are prohibited from sharing their account credentials or granting access to AlmaBetter’s proprietary resources to unauthorized individuals or entities.

Enforcement and Consequences for Infringement AlmaBetter actively monitors unauthorized use and infringement of its intellectual property. Any identified infringement will result in immediate account suspension, permanent termination of access to services, and potential legal action to protect AlmaBetter’s rights and interests. Users agree to compensate AlmaBetter for all damages, legal costs, and associated expenses incurred due to any infringement activities.

DND (Do Not Disturb) Policy Exemption Details Users expressly acknowledge and consent that communications from AlmaBetter are exempt from any national or regional Do Not Disturb (DND) registries or similar opt-out lists. Registration with AlmaBetter implies understanding and agreement that AlmaBetter may reach users for the purposes described above, regardless of any DND status.

Issuance Process Upon successful completion of the courses offered by AlmaBetter, including fulfillment of all prescribed academic requirements, assessments, and other performance criteria, students are issued formal certifications. The certification process involves verification of course completion and validation of performance metrics by AlmaBetter’s academic team.

Educational Partners AlmaBetter issues certifications in collaboration with esteemed educational partners, currently including IIT Guwahati and Woolf University. These partnerships enhance the credibility and industry recognition of certifications provided by AlmaBetter. Students should be aware that educational partnerships may evolve as AlmaBetter continuously strives to enhance educational quality and industry alignment. Any modifications or changes to these partnerships will be communicated transparently and fairly to students, ensuring minimal disruption and maximum clarity.

Fairness and Transparency in Partnership Changes AlmaBetter is committed to fairness, transparency, and student interests in managing educational partnerships. Any modifications, additions, or discontinuations of educational partnerships will be communicated clearly and promptly to all affected students. AlmaBetter will make all reasonable efforts to ensure that such changes have minimal impact on students' learning experience and certification value. Decisions regarding partnership changes are guided by AlmaBetter’s commitment to maintaining and enhancing the quality and credibility of its educational offerings.

Section 13: Limitation of Liability

Extent of Liability Limitations The liability of AlmaBetter, including its directors, officers, employees, and affiliates, arising out of or related to these Terms of Use, or the use of AlmaBetter’s services or Platform, is strictly limited to the total fees paid by the user for the particular course or services involved. AlmaBetter shall not be liable for any damages exceeding this amount under any circumstances.

Specific Exclusions of Indirect or Consequential Damages AlmaBetter explicitly disclaims and excludes liability for any indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to lost profits, loss of data, loss of opportunities, or business interruption arising from or in connection with the use or inability to use AlmaBetter’s services or Platform.

Clarifications of AlmaBetter’s Liability Scope AlmaBetter’s liability is expressly limited to direct damages as specified above. AlmaBetter bears no responsibility for user actions or third-party conduct, technological failures outside its direct control, or any inaccuracies or inadequacies in user-provided information. Users acknowledge these limitations of liability as fundamental terms governing their relationship with AlmaBetter.

Section 14: Indemnification

User Responsibilities in Indemnifying AlmaBetter Users expressly agree to indemnify, defend, and hold harmless AlmaBetter, its affiliates, directors, officers, employees, and partners against any claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to user activities, actions, omissions, or violations of these Terms of Use.

Scope and Scenarios of Indemnification The scope of indemnification includes but is not limited to scenarios involving:

User breach or violation of any term, condition, or provision of these Terms of Use. Misuse or unauthorized use of AlmaBetter’s Platform, resources, or intellectual property. User-generated content that violates third-party rights, laws, or regulations. Unauthorized actions leading to security breaches, data loss, or damage to AlmaBetter’s reputation or services.

Procedures for Indemnification Claims Upon receiving notice of a claim subject to indemnification, AlmaBetter will promptly notify the concerned user. Users are obligated to cooperate fully in the defense of any claim. AlmaBetter reserves the right to assume the exclusive defense and control of any matter subject to indemnification at its sole discretion and at the user’s expense. Users shall not settle any indemnifiable claim without AlmaBetter’s prior written consent.

Section 15: Third-party Links and Resources

Disclaimer on External Content AlmaBetter’s Platform may include links, references, or access to third-party websites, services, or resources. AlmaBetter does not endorse, verify, control, or guarantee the accuracy, quality, or legality of content or services provided by external third-party resources.

User Responsibilities Regarding External Resources Users acknowledge and agree that interactions or engagements with third-party websites or resources accessed through AlmaBetter’s Platform are solely at their own risk. Users bear full responsibility for reviewing and complying with the third-party terms of use, privacy policies, and any other applicable regulations when engaging with external resources.

AlmaBetter’s Non-liability in External Resource Interactions AlmaBetter explicitly disclaims all responsibility and liability for any direct or indirect damages, losses, or liabilities arising from users’ interactions with external third-party resources or reliance upon content provided by third-party websites or services. Users agree that AlmaBetter shall have no obligation to intervene, mediate, or resolve any disputes or issues arising from third-party interactions.

Section 16: Governing Law, Jurisdiction, and Arbitration

Governing Law and Jurisdiction These Terms and your use of the Services will be interpreted in accordance with the laws of India excluding its rules on conflicts of laws. You and we agree to submit any dispute arising under these Terms to the personal jurisdiction of a court located in Bangalore for any actions for which the parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Any dispute, claim or controversy arising out of or relating to this Terms including the determination of the scope or applicability of this Terms to arbitrate, or your use of the Application or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator mutually appointed by Members and AlmaBetter. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Bangalore. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.

Section 17: Grievance Redressal Mechanism

Process for Lodging Grievances Users who experience any issues, concerns, grievances, or dissatisfaction related to AlmaBetter’s services, Platform functionality, administrative matters, or any interactions facilitated through AlmaBetter’s Platform must formally lodge their grievances via the officially designated channels. Grievances must clearly articulate the nature of the complaint, relevant facts, detailed information, and include appropriate supporting documentation or evidence, if applicable, to substantiate the claims made.

Contact Information All grievances must be formally submitted to AlmaBetter’s designated Grievance Officer exclusively via email at support@almabetter.com. Users are expressly advised to mention “Grievance” clearly in the subject line of their communication to ensure expedited processing and accurate routing to the relevant authorities within AlmaBetter’s management team.

Timeline for Response and Resolution Upon receipt of a grievance, AlmaBetter’s Grievance Officer shall issue an acknowledgment confirming receipt within three (3) business days. The Grievance Officer, supported by relevant internal departments, will diligently review, investigate, and seek to resolve the grievance within fifteen (15) business days from the date of acknowledgment. During this investigative period, AlmaBetter will maintain transparent and regular communication with the complainant, providing periodic updates on the progress of the resolution process.

If the grievance is complex, involves detailed investigation, or requires additional information or documentation, AlmaBetter reserves the right to extend the resolution timeline. Any extensions or delays will be clearly communicated to the complainant, along with justified reasons for the additional time required. Upon conclusion of the grievance investigation, AlmaBetter will formally communicate the outcome, detailing the actions taken or resolutions implemented. Users acknowledge and agree that AlmaBetter’s decision regarding grievance resolutions is final and binding.

Section 18: Modifications to Terms of Use

AlmaBetter’s Rights and Procedures for Updates AlmaBetter reserves the exclusive and unequivocal right to modify, amend, or update these Terms of Use at any time and at its sole discretion. Such modifications may be necessitated by operational adjustments, legal compliance requirements, enhancements of user experience, or shifts in market dynamics. AlmaBetter undertakes to ensure that updates or amendments will be transparent, clear, and communicated to all existing users timely.

User Responsibilities Regarding Reviewing Updates It is the explicit responsibility of each user to regularly review these Terms of Use. Continued use or access to AlmaBetter’s Platform or services subsequent to any modification of the Terms of Use shall constitute the user’s explicit and unequivocal consent and acceptance of the revised Terms. Users who do not agree with any updated or modified terms must discontinue their use of AlmaBetter’s Platform and services immediately.

Section 19: Miscellaneous Provisions

Force Majeure AlmaBetter shall not be held responsible or liable for any delay, disruption, or failure to perform obligations under these Terms due to circumstances or events beyond its reasonable control, including but not limited to acts of God, natural disasters, wars, terrorism, civil unrest, governmental regulations, network failures, or technological disruptions. AlmaBetter will endeavor to promptly resume performance as soon as reasonably possible following such events.

Entire Agreement These Terms of Use constitute the entire agreement and understanding between AlmaBetter and its users regarding the use of AlmaBetter’s services and Platform. This agreement supersedes all prior agreements, understandings, negotiations, and discussions, whether written or oral, regarding the subject matter herein.

Severability of Clauses Should any provision of these Terms be deemed illegal, invalid, or unenforceable under applicable law, the remaining provisions shall remain fully effective, valid, and enforceable. The affected provision shall be revised or interpreted in such a manner as to accomplish the intent of the original provision to the greatest extent permissible under the law.

Non-waiver Clause Any failure or delay by AlmaBetter in exercising or enforcing any right or remedy available under these Terms shall not constitute a waiver of such right or remedy, nor shall it affect AlmaBetter’s ability to subsequently enforce such right or remedy. Assignment Rights AlmaBetter reserves the absolute right to assign, transfer, or delegate its rights, obligations, or responsibilities under these Terms to any third party, affiliate, or successor at its sole discretion without requiring prior notice or user consent. Conversely, users are strictly prohibited from assigning or transferring any of their rights, obligations, or responsibilities under these Terms to any third party without AlmaBetter’s explicit prior written approval.

By accessing, registering, enrolling, or utilizing any services or features provided by AlmaBetter’s Platform, you explicitly affirm and acknowledge that you have thoroughly read, fully understand, and unconditionally accept all the provisions outlined in these Terms of Use. Your agreement and acceptance are voluntary and free from any coercion, undue influence, or misrepresentation by AlmaBetter or its affiliates. You agree to maintain compliance with all terms stated herein for the entire duration of your interaction and engagement with AlmaBetter.
